Terms of Service, safety & platform rules

1. Venue only — marketplace, not seller

ObsessionAuction is a venue only connecting independent buyers and sellers. ObsessionAuction (and its owner/operator) does not own, possess, inspect, test, sanitise, ship, or guarantee any item listed. A purchase is a contract solely between buyer and seller. Listings, descriptions, photos, ratings and reviews are provided by users.

2. Eligibility — 18+ and US only

You must be at least 18 years old and a US resident located in the United States to register, buy or sell. Shipping within the US only. By registering you represent that you meet these requirements. One account per person unless we agree otherwise; you are responsible for your account and password.

3. All sales final — no refunds

ALL SALES FINAL. NO REFUNDS on completed purchases, memberships, or fees, except where a refund is required by applicable law. Buy carefully, read descriptions, and ask questions on-platform before buying/bidding. Bids and Buy Now purchases are binding commitments to pay.

4. Fees

ObsessionAuction charges sellers 9% commission on the hammer price or Buy Now price (seller receives 91%, plus the shipping amount the seller set). Memberships: Free $0, Silver $5/month, Gold $15/month — membership fees are non-refundable except where law requires. Fees may change with notice for future transactions.

5. Seller responsibilities

Sellers are independent sellers, not employees, agents, partners or franchisees of ObsessionAuction. Each seller represents they: own or have the legal right to sell each item; items are lawfully obtained; descriptions/photos are accurate and tasteful/non-explicit; worn items and, where applicable, Adult Toys (Used) are sanitised as stated and only items that can be safely sanitised are listed; they ship promptly, discreetly in plain packaging, and comply with USPS/carrier rules and all federal, state and local law; and they handle buyer questions, shipping and any legally-required remedies for their own sales.

6. Buyer assumptions & risk

Buyers assume the risks inherent in buying used/worn items from independent sellers, including as to quality, fit, hygiene preferences, shipping delay or loss caused by a seller/carrier, and description differences. Inspect/sanitise items on receipt as appropriate. Keep communication and payment on-platform.

7. Prohibited items & conduct

No: minors or anything involving minors; illegal, stolen, recalled or otherwise prohibited items; items that cannot be safely sanitised in Adult Toys (Used); counterfeit where prohibited; hazardous, biohazardous or unsafe items; explicit/nude imagery; meetups, off-platform payment solicitation, harassment, fraud, chargeback abuse, bid manipulation, spam, or unlawful conduct. We may remove listings/accounts at our discretion.

8. Auctions & Buy Now

Minimum starting bid $10. First bid starts a 15-second soft close. Highest bidder when the auction closes wins and must pay within 24 hours or the item may be relisted. Where a seller sets an optional Buy Now price ($25 minimum, and more than the starting price), a buyer may end the auction immediately at that price while the current price is below the Buy Now price, until the item is bought or the auction ends. Once the current price reaches or exceeds the Buy Now price, Buy Now is unavailable and the auction continues by bidding only. 9% commission applies to the Buy Now price exactly as to a hammer price.

9. Payments, chargebacks & disputes

Demo checkout is mocked; in production a third-party processor will apply its terms. You agree not to initiate a payment dispute/chargeback for a purchase consistent with these terms without first contacting us and the seller through the platform; fraudulent or abusive chargebacks may lead to closure and collection of amounts/fees permitted by law. Nothing here waives rights that cannot be waived by law.

10. Ratings

Star ratings and comments are user opinions, not ObsessionAuction endorsements or guarantees.

11. Intellectual property

You keep rights in content you post and grant ObsessionAuction a licence to display it to operate the marketplace. Do not post content you do not have the right to use. Site branding is owned by ObsessionAuction/its owner.

12. Termination

We may suspend or terminate accounts/listings for violations, risk, non-payment, or legal reasons. You may close your account subject to completing pending transactions and obligations that survive by nature.

13. No warranties; limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ITEMS SOLD BY SELLERS ARE PROVIDED "AS IS" WITHOUT WARRANTIES BY OBSESSIONAUCTION OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OBSESSIONAUCTION AND ITS OWNER SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, OR FOR SELLER/BUYER ACTS, ITEMS, SHIPPING OR CONTENT, AND ANY DIRECT LIABILITY SHALL NOT EXCEED THE FEES OBSESSIONAUCTION RECEIVED FROM YOU IN THE 3 MONTHS BEFORE THE CLAIM (OR $100 IF NONE) — EXCEPT WHERE LAW REQUIRES OTHERWISE.

14. Indemnification

You agree to defend, indemnify and hold harmless ObsessionAuction and its owner/operator from claims, damages, liabilities, costs and reasonable attorneys' fees arising from your listings, purchases, content, shipping, violation of these terms or law, or infringement — to the extent permitted by law.

15. Disputes — arbitration, class waiver, Missouri law

PLEASE READ: To the extent permitted by law, disputes will be resolved by binding individual arbitration in Missouri (or small-claims court where eligible) under Missouri law, and you waive jury trial and class/collective actions. If arbitration is held unenforceable for a claim, that claim will be brought in state or federal courts located in Missouri and you consent to jurisdiction there. You may opt out of arbitration by written notice within 30 days of first accepting these terms (email via the Feedback page, labeled "Arbitration opt-out").

16. Changes & contact

We may update these terms; the version/date will be posted and material changes will apply prospectively or as required by law. Continued use after changes take effect constitutes acceptance. Questions: use the Feedback page.
